How do I make sure I'm following labor laws for providers I hire to care for my child?

If you're hiring care providers yourself rather than going through an agency, you will want to make sure you're following local labor laws as their employer. For example, if your child is in the Self-Determination Program in California and you hire a respite provider, you may be considered the employer responsible for that provider, depending on the financial management service (FMS) you use.

Your state's website should have information on workers rights for employers to follow. For example, in Oregon, the state's Bureau of Labor and Industries website has a page for employers.

To find an attorney to help you make sure you're in compliance, contact the local bar associations in your area, which may have referral lists.
