How do I request that benefits continue while I appeal a denial?

Published: Oct. 31, 2025Updated: Apr. 21, 2026

If you have received a denial for public benefits such as Regional Center, IHSS, or Supplemental Security Income (SSI), you can appeal the denial. The paperwork notifying you of the denial should have instructions for how to request your appeal, and there may also be instructions for how you can request that your child's benefits or services continue at the same level until the appeal is resolved. This is called "aid paid pending appeal." There may be a box to check on the appeal form, or you may need to request "aid paid pending appeal" on your appeal form.

Note that you typically have a shorter window of time to submit your appeal if you want to continue receiving benefits during the appeal process. For example, you must submit an SSI appeal request within 10 days of receiving the denial in order to get aid paid pending appeal, while the normal deadline is 60 days.

Our step-by-step goals can walk you through the appeal process for different public benefits programs.
