Sample Letter of Agreement or Disagreement with IEP

Before you sign your child's IEP, it is important to note specific details in the IEP that you disagree with and why. You can write on the signature page itself, if there is room, or you can write a letter of disagreement that you attach to the document. If you attach a letter, make sure to refer to the letter on the signature page; for example, “see attached letter, dated 11/27/2022.” By indicating that a letter is attached, you can help ensure that it stays with the IEP document and does not get misplaced.

RE: Mary Jones, Kindergarten student, IEP dated 11/17/21

Dear Ms. Smith,

Please accept this letter as our agreement to the IEP dated November 17, 2021, and attach it to the IEP as page 29a. The signatures on this letter will be the signatures in agreement/disagreement to the IEP.

We agree to all of the goals, services, and accommodations listed in the IEP as well as the Behavior Support Plan presented at the meeting.

We agree with the Learning Center consultation time of 90 minutes per month; however, we consider this service to be insufficient to meet Mary’s needs in her least restrictive environment of the general education classroom. It was noted in the IEP that Mary had only partially met her IEP SAI goals 2–4 and had lost skills in SAI goal 5. We agree with the Learning Center teacher’s statement that part of the reason Mary had not met those goals is because her LC instruction was provided by a paraprofessional.

We request that the IEP team reconvene to discuss direct LC services for Mary within her general education classroom, or that the LC consultation time be increased to 120 minutes per month (30 minutes per week) so that the paraprofessional can have direct guidance on how to work on Mary’s goals. We understand that the district has 30 days from the date of this letter in which to call the IEP meeting, and we also understand that the winter holiday will not be counted in those 30 days.

We thank all of Mary’s team members for attending the IEP and for their continued support. We look forward to working with the team as Mary continues her education.
