What happens when my child transfers from private school to public school?

Published: Sep. 4, 2025Updated: Feb. 23, 2026

If your child with an IEP attends a private school, their IEP remains intact, just not implemented because private schools are not legally obligated to provide IEP services. Your school district of residence is still responsible for conducting an annual IEP and triennial assessments if you consent to them. Education advocates recommend that parents consent to these assessments because they will measure your child's progress at their private school and reflect any areas of need. If you decide to transfer your child from private school to public school, the district can draw upon the most recent assessments to begin the IEP process at the new school, or your IEP team may decide that new assessments are necessary.
