What if I disagree with the eligibility category in my child's IEP?
Every child with an IEP will have one or more eligibility categories assigned. Parents should note that the eligibility category is just opening the door to services and is not a medical diagnosis. The eligibility is outlined in the education code and doesn’t affect assessments or services (unless the category is emotional disturbance or intellectual disability).
The psych assessment ends with a conclusion of what eligibility a child qualifies for, but the category doesn’t impact the assessments. What impacts the assessments are concerns brought up by parents and teachers.
Parents can disagree with the edibility category if they want, but they should agree that the child is eligible for an IEP when signing.
