What if I don't agree when the school wants to change my child's placement?
The law guarantees your child access to a free, appropriate public education, and you have a say in what placement is appropriate for your child. You can make a case for what your child requires to receive FAPE. Here are the main questions to discuss with your team: Will your child make progress in that setting? What supports do they need to make progress in that setting?
The school cannot change your child's placement without your consent. If the school recommends a change of placement, they must send prior written notice and hold a meeting with the parents, and parents must consent to the proposed change prior to any change taking place.
If you do not agree with your IEP team’s recommendation for placement:
- Sign your IEP with the exception of placement and follow steps to resolve your disagreement.
- Remember that you have stay-put rights, so your child can remain in the current placement until your disagreement is resolved.
