What is Lanterman Act provisional eligibility status?
If your child has been receiving early intervention services from Regional Center, they will be assessed at age 3 to determine if they are eligible for full Regional Center services under the Lanterman Act. Provisional eligibility status lets your child continue receiving services until age 5, but it is not the same as full Lanterman eligibility.
If your child has been given provisional eligibility status and you want them to receive full Lanterman Act services, you need to establish:
Your child has a qualifying diagnosis (cerebral palsy, epilepsy, autism, intellectual disability, or other conditions closely related to intellectual disability or that require similar treatment)
Your child has a substantial disability, meaning impairment in at least three of these areas: learning, mobility, receptive and expressive speech, self-care, and self-direction.
If Regional Center denies your child full eligibility, they might argue that your child only has one or two of the three areas of limitations. If you disagree with Regional Center's determination of your child's eligibility, you can appeal.
